Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with My First Drive Driving School - EIN 88-3174451.

GRADING/PROGRESS

• Progress standards must meet the requirements of the current rules adopted by the Texas Department of Licensing & Regulation (TDLR). Mastery is a prerequisite to awarding a grade of 70 or above. Evidence of mastery shall be determined by one or more of the following methods: 1) unit tests; 2) written assignments; 3) skills performance checklist; and 4) comprehensive examinations of knowledge and skills.

RULES OF OPERATION AND CONDUCT

• A student or prospective student may be dismissed or barred from the school for tardiness; drunkenness or obvious signs of drug use; rude, vulgar, or disruptive behavior; smoking or using tobacco products; using a cell phone during class or in the car; or being otherwise inattentive (sleeping, texting, reading, etc.). Students terminated for violating rules of conduct may be readmitted at the discretion of the school director.
• Student must have a valid State of Texas learner's permit in order to book  a driving lesson.  Driving lesson(s) booked without a valid permit will result in forfeiting fee of the scheduled driving lesson. 
• The student must bring his or her learner’s permit to each driving lesson. In a situation where student does not have his or her permit, the instructor will not be able to drive the student and the student will forfeit fee for the scheduled driving lesson.
• All course content, driving lessons, and road test must be completed within 12 months of purchase.
• It is student's/parent's responsibility to keep track of scheduled lessons once a lesson has been booked.  Any reminders or notifications besides this email are purely for courtesy and can be stopped anytime without prior notice.
• Cancellation, non-attendance or the rescheduling of a booking with less than 48 hour notice will result in forfeiting the full booking fee for the schedule lesson.

DAMAGE TO POROPERTY

• A fee of up to $1000 will be charged if a student defaces or damages any school property (desks, tables, vehicle, etc.). A damaged or lost DE-964 or ADE-1317 form can be replaced at a cost of $30. An administrative fee of $50 is charged if any kind of refund is requested after the first day of the class. 

CANCELLATION POLICY

• Cancellation, non-attendance or the rescheduling of a booking with less than 48 hour notice will result in forfeiting the full booking fee for the schedule lesson.
• A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at My First Drive Driving School.
• A full refund of all money paid by a student if the student cancels the enrollment contract before midnight of the third day, other than a Saturday, Sunday, or legal holiday, after the date the enrollment contract is signed by the student, unless the student successfully completes the course or receives a failing grade on the course examination; or the enrollment of the student was procured as a result of a misrepresentation in advertising or promotional materials of the school or course provider; or a representation made by an owner or employee of the school or course provider.

STUDENT PICKUP AND DROP OFF

• Student and or parent/guardian must ensure that the student is picked up from the driving school immediately upon completion of the scheduled lesson. My First Drive Driving School, its employees, its contractors, its driving instructors or any other staff will not be liable for any harm incurred to the student outside of the scheduled driving lesson time.  On certain occasions, during and outside of business hours, during weekdays and weekends, access to the lobby may have restricted and it is responsibility of the student, parent, and/or the guardian to make sure that the student is not left unattended outside the building and picked up immediately upon completion of the driving lesson. 

NOTICE TO TEEN PARENTS/GUARDIANS

• As the parent or guardian of a teenager, you are entitled to know the minimum requirements of a teen driver education course. There are thirty-two (32) required hours of classroom instruction. Your teen must attend the first six (6) hours of classroom instruction before a learner’s permit will be issued by DPS. Only two (2) hours of scheduled classroom instruction are permitted per day.
• The classroom instruction phase shall be completed within the timelines stated in this contract and all 32 hours must be attended and successfully completed or made up. If a student fails to successfully complete the 32 classroom hours, this school is required to contact DPS and cancel the learner’s permit. Seven (7) clock hours of in-car driving instruction and an additional seven (7) clock hours of in-car observation are required. A two-hour increment of behind-the-wheel instruction may be offered once during the behind-the-wheel phase of instruction for each student. Thirty (30) additional clock hours of behind-the-wheel instruction must be provided to young drivers and certified by a parent or guardian before a teenager may progress to Phase 2 of the Texas’ Graduated Driver Licensing program.
• If your teen transfers to another school or driver training program, timelines may change and credits for classroom and/or in-car training may not be transferable to the new driver training school. The entire driver education course must be completed within the timelines stated in this contract. (Note: During peak enrollment periods, in-car instruction times could be subject to availability.) ACKNOWLEDGEMENT

• I have been furnished a copy of the school tuition schedule; cancellation and refund policy; makeup policy and school regulations pertaining to absence, grading policy, progress, and rules of operation and conduct. The school maintains a business insurance policy for vehicles with coverage as required by Texas Transportation Code, Chapter 601, and uninsured or underinsured motorist coverage. I understand that the school is prohibited from issuing a DE-964 or ADE-1317 if the student has not met all the requirements for course completion, and the student should not accept a DE-964 or ADE-1317 under such circumstances. I further realize that any grievances not resolved by the school may be forwarded to Texas Department of Licensing and Regulation Attention: Enforcement Division PO BOX 12157 Austin, TX 78711; 800-803-9202 www.tdlr.texas.gov/complaints. This agreement constitutes the entire contract between the school and the student, and assurances or promises not contained herein shall not bind the school or the student.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that My First Drive Driving School can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. My First Drive Driving School cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• My First Drive Driving School has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other My First Drive Driving School service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, My First Drive Driving School has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other My First Drive Driving School service. Such termination of the Service will result in the deactivation of your Account.
  

 

Refund Policy

REFUND POLICY

• The effective date of the termination for refund purposes will be the earliest of the following: (a) the last day of attendance, if the student is terminated by the school; (b) the date of receipt of written notice from the student; or (c) the 10th school day following the last day of attendance.
• If tuition is collected in advance of entrance and, if a student does not enter the school, terminates enrollment, or withdraws, the school: (a) may retain not more than $ 50.00 as an administrative expense; and (b) shall refund that portion of the classroom tuition and fees and behind-the-wheel tuition and fees that correspond to services the student does not receive.
• The school shall refund items of extra expense to the student, including instructional supplies, books, laboratory fees, service charges, rentals, deposits and all other charges not later than the 30th day after the effective date of enrollment if: (a) the extra expenses are separately stated and shown in the information provided before enrollment; and (b) the student returns to the school any property in the student’s possession.
• A full refund of all tuition and fees is due and refundable in each of the following cases: (a) when an enrollee is not accepted by the school; (b) if the course of instruction is discontinued by the school at this location; or (c) if the student’s enrollment was procured as a result of any misrepresentation in advertising, promotional materials of the school, or misrepresentation by the owner or representation of the school.
• Refunds shall be completed within 30 days after the effective date of termination; there are no refunds after the certificate issuance.
• Learner license/permit and/or road test certificate will not be issued until complete payment has been received.

 

 

Modifications to Services and Prices

• My First Drive Driving School reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• My First Drive Driving School shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Vouchers

• Vouchers are non-refundable and cannot be redeemed for cash.
• Unused vouchers cannot be transferred between clients.
• Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.
• Vouchers are valid for 12 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by My First Drive Driving School for payment processing.
  
• All fees and transactions are in United States Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by My First Drive Driving School.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any My First Drive Driving School customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that My First Drive Driving School uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• My First Drive Driving School does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that My First Drive Driving School shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if My First Drive Driving School has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of My First Drive Driving School to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that My First Drive Driving School shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
